When you purchase a session, you are agreeing to all of the following terms:
Entire Agreement: This agreement contains the entire understanding between C&J Photography/Inkd Boudoir VA and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing and signed by all parties involved.
Payment & Prices: All costs are as stated at the time of booking & will remain once booking is confirmed. The full contract amount is due the day of service. All sessions require half down and weddings require $300 down non-refundable retainer due at booking and comes off total amount. Remaining balance is due 2 days prior to your session date. If payment is needed to be used for remaining balance, client can reach out to photographer to discuss payment plan. Upon your purchase, C&J Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the deposit is non-refundable.
Refunds: Refunds are based on the discretion of the photographer and issued back pending needs of refunds. Refunds are only issued back to clients if a date is no longer needed or a new date can not be scheduled between photographer and client. All retainers put down for all sessions are non-refundable. Refunds will be issued only for remaining balance and any add-on's clients added at booking. No refunds will be giving back for following reasons: Client shows up late; choice of clothing, hair or makeup on clients; anyone not acting up/no having it/smiling/grumpy/crying; weather.
If client does not show up or does not communicate with photographer, client will forfeit their retainer, however client can reschedule up to 3 months after original date and retainer will move to new date. If client does not reschedule after 3 months, clients will forfeit previous retainer and a new retainer must be put down in order book the new date and time. Should the client need to reschedule a 3rd time a $100 fee will apply along with the new retainer fee must be put down to rebook the new session with photographer. After a 4th attempt of no call no showing/no communication/will not work with dates given/or will not put down the fee plus retainer client will be blacklisted with photographer and will no longer work with client at anytime in the future.
*Client understands that to rebook studio an additional fee pending the time needed to rebook will be invoiced to client and must be paid in full prior to rebooking the studio and the whole fee will go towards the rental fees of the studio only.
Note that due to weather, illness or any mechanic issues, death in family client and photographer will make all efforts to find a new suitable date and times that work best with photographers calendar and clients.
Reschedule: Due to the time specific nature of this service, clients may only reschedule with 24 hour notice unless sickness related. If a client reschedules / cancels three times they forfeit their deposit. If they wish to book another session payment is due in full to book & will be non-refundable and non-transferable. If a client no call / no shows to a session they forfeit any money paid. If the request another session payment is due in full and non-refundable & non-transferable.
Torrential Weather: If the weather is torrential and Photographer determines the shoot is not possible, the session will be rescheduled for another day.
Personal Cameras & Additional Photographers: Client may not bring their own camera, or recording equipment to the session. If a camera is present, Photographer will have to request that it be put away. No other professional photographers may be working an event C&J Photography is scheduled to work unless they are employed by C&J Photography. NO CELL PHONE IMAGES may be taken during any session unless discussed prior.
Requested Coverage: C&J Photography will honor requested photographs but does not guarantee any specific photographs, editing style, or poses.
Artistic Style: Client acknowledges that she/he has viewed examples of previous work and is satisfied with the overall style of photography that is presented. Client understands that differences in locations, subjects and lighting allow for variations in the final outcome of the Session. There is no knowing what photos will be produced from this endeavor simply because this is an event in the future. Photographer reserves the right to artistically interpret how to photograph a scene. Heavy editing such as bra removal, heavy air brushing etc., will only be done at extra charge and at the discretion of the photographer. This may mean that some shots are color and some may be black and white.
Cooperation & Physical Liability: All parties agree to cheerful cooperation and communication for the best possible result within the definition of this Assignment. Photographer is not responsible for missed images due to any individual’s failure to appear or cooperate during the Assignment. If there is any threat to the Photographer or their equipment by any subject, Photographer reserves the right to end coverage immediately with no further liability to finish the Assignment, with no refunds given. Additionally, Client is responsible for their own conduct and the conduct of all participants in the Session. Any damage to equipment & props caused by the client are the sole financial responsibility of the client. Client agrees to hold Photographer harmless for any injuries or damages sustained preceding, during, and immediately following the Assignment.
Copyright & Reproductions: The Photographer owns the copyright to all images created during the Session and shall have the exclusive right to make reproductions. The Photographer maintains the right to make reproductions for the client or for the Photographer’s portfolio, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio. Photographer will use images on social media platforms for marketing purposes. Photographer reserves the right to revoke access to any gallery delivered to the client in the event the client changes the images in any way. The changes are not limited to adding filters, cropping etc. NO UNEDITED RAW files will never be released to the client.
Photographer: The Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness or personal crisis. In the event of such substitution, Photographer warrants that the photographer taking the photographs shall be a competent professional.
LIMIT OF LIABILITY: In the unlikely event that the Photographer cannot perform this agreement due to a medical or natural emergency, the deposit & any other funds paid will be returned to the client. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
Chargebacks: C&J Photography reserves the right to present proof of these Terms and Conditions of Use to the financial institution investigating the dispute. Documents to be presented will be, but not limited to Terms and Conditions, Invoice receipt with clear terms and Booking contact stating you understand the refund policy. Booking with C&J Photography you are stating you are aware of any and all policies regarding refunds and scheduling.
Inherent Qualities: Client is aware that color dyes in photographs and photography products may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. Client is also responsible for downloading all digital images within 45 days of the session gallery release. After the 45 days the photographer may delete all images from the computer & hard drives. Wedding photos will be available through an online gallery for six weeks. After this time frame the photographer may delete the online gallery.
Turn Around on Images: Client understands delivery of final product is done within a 3-4 week time frame (January-August). Turn around time in the fall (September-December) is 5-6 weeks due to busy season. Wedding galleries are returned within 6 to 8 weeks or 8 to 10 weeks during busy season. Moving of session due to sickness on behalf of the photographer or client changes delivery time. Photographer will reach out once the gallery is finished and all galleries is are sent by email only. Turn around is an estimate based off of schedule and time of year and may need to be adjusted based on photographers availability. No date is promised or kept on hold without down retainer and signed contract.
Traveling and Fees: We are based in Roanoke, VA however we have done many sessions and weddings around the valley including Roanoke, Botetourt, Salem, Rocky Mount, Union Hall, Smith Mountain, Covington, Callaway. We can travel as needed for any session or wedding as needed. If your session/wedding is within 2 hours of Roanoke no fee will be charged, however if it is 3 or more hours away a travel fee of $150 will be invoiced to our clients prior to wedding date. If lodging is requested a lodging fee of $200 will be invoiced to our clients prior to the wedding and will ask of lodging places that are requested we stay in. For destination weddings both a travel fee and lodging will be discussed by client and us.
